Welcome to Flowgrid ("we", "our", "us"). By accessing or using our website and services, you agree to comply with the following terms.
1. Overview
Flowgrid is a product analytics tool designed for entrepreneurs, agencies and startups to gain insights into their startups and online platforms. Users cannot yet sign up for a free trial, a subscription fee is required for continued use.
2. Accounts
To use Flowgrid, you must provide accurate and complete information, including your name, company details, and payment information. By subscribing, you agree to pay any applicable fees for the Service. You are responsible for maintaining the confidentiality of your account login credentials and for all activities that occur under your account. You agree to notify Flowgrid immediately of any unauthorized use of your account or any other breach of security.
3. Data Collection by Flowgrid (on flow-grid.xyz)
When you use our own website and platform (flow-grid.xyz), Flowgrid collects certain non-personal data, which may include unique identifiers (such as `visitor_id` and `web_id`), IP addresses (which are anonymized where possible), referral data, browser information, and usage patterns to provide and improve our services, for internal analytics, and to enhance your user experience. We do not collect personal data such as your name or email address from your visitors through the analytics script unless you explicitly configure the software to do so (e.g., by passing user IDs). 4. Cookies, Data Usage, and GDPR/PDPA Compliance
Flowgrid uses cookies and similar technologies (e.g., local storage, pixels) to enhance user experience, for analytics purposes, and to track user behavior on our own platform (flow-grid.xyz
). When your clients use the Flowgrid software on their websites, the software may set cookies and collect data on their behalf. By using our site or allowing your users to deploy our software, you agree to our use of these technologies.
Data Collection and Usage
The data collected through our analytics software (via the software installed on your website or your client's website) is used solely for analytics purposes as described in our Privacy Policy. This includes tracking visitor behavior via unique identifiers, cookies, and anonymized IP addresses. We respect user privacy and are committed to protecting it. We do not sell any collected data to third parties. For debugging or support purposes, particularly when assisting users with issues they report, authorized Flowgrid personnel may need to access specific user data related to their account or usage to diagnose and resolve problems effectively.
GDPR/PDPA Compliance and User Responsibilities
Flowgrid is committed to assisting with compliance with global data protection regulations, including the General Data Protection Regulation (GDPR) and Singapore‘s Personal Data Protection Act (PDPA).
As a user of Flowgrid, you acknowledge that Flowgrid acts as a Data Processor for any data collected via the analytics script installed on your website (or your client‘s website), while you (or your client) are the Data Controller.
As the Data Controller, you are responsible for:
- Obtaining Explicit Consent: You must implement a Consent Management Platform (CMP) and display a clear cookie consent banner on your website. You are responsible for obtaining explicit consent from your website visitors before collecting any non-essential data (including IP addresses, cookie-based data, or other personal data as defined by applicable laws) through our script. This includes ensuring the Flowgrid script‘s tracking functionalities are only activated once the user has provided the necessary consent.
- Providing Information to Users: You must inform your visitors, through a clear and easily accessible Privacy Policy and Cookie Policy on your website, about the nature of the data collected by Flowgrid, its purpose (analytics), how it will be used, and the third parties involved (i.e., Flowgrid as your data processor).
- Facilitating Data Subject Requests: You are responsible for addressing GDPR-compliant (e.g., Right to Access, Right to Erasure, Right to Rectification) and PDPA-compliant requests (e.g., Access and Correction Obligations, Withdrawal of Consent) from your website visitors. Flowgrid will assist you in fulfilling these obligations where technically feasible and required by law.
Flowgrid, as the Data Processor, will:
- Process Data as Instructed: We will only process data in accordance with your documented instructions and the terms outlined in this agreement, subject to our own legal obligations.
- Ensure Data Security: We implement appropriate technical and organizational measures to protect the data we process on your behalf against unauthorized or unlawful processing and against accidental loss, destruction, or damage.
- Assist with Compliance: Flowgrid will assist you in meeting your data protection obligations, such as responding to data subject requests and, where applicable, providing information for data protection impact assessments.
- Notify of Data Breaches: In the event of a personal data breach affecting data we process on your behalf, we will notify you without undue delay.
5. Intellectual Property
All rights, title, and interest in the Flowgrid Service, including all software, documentation, and content (excluding your website‘s content and data), remain the exclusive property of Flowgrid Inc. You agree not to reverse-engineer, decompile, or otherwise attempt to discover the source code of our Service.
6. Use of Service
You agree not to misuse the Service or help anyone else do so. This includes, but is not limited to, reverse-engineering, attempting to gain unauthorized access, interfering with our platform‘s functionality, or using the Service for any unlawful purpose.
7. Termination
We reserve the right to suspend or terminate your access to the Service at our sole discretion, without prior notice, if you violate these Terms, our Privacy Policy, or if your actions pose a security risk or harm to our Service or other users. Upon termination, your right to use the Service will immediately cease, and all data associated with your account may be deleted as per our data retention policy.
8. Disclaimers
The Service is provided as-is and "as available" without warranties of any kind, either express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee that the Service will be error-free, uninterrupted, secure, or that any defects will be corrected.
9. Limitation of Liability
To the fullest extent permitted by applicable law, Flowgrid Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the Service; (b) any conduct or content of any third party on the Service; (c) any content obtained from the Service; and (d) unauthorized access, use, or alteration of your transmissions or content.
10. Governing Law
These Terms are governed by the laws of Singapore, without regard to its conflict of law principles. Any disputes arising out of or relating to these Terms or the Service will be resolved in the courts of Singapore.
11. Updates to Terms
We may update these Terms from time to time. You will be notified of any material changes via email or prominent notice on our website. Your continued use of the Service after the effective date of the revised Terms constitutes your acceptance of the changes.
